CEPRA II Beach Renourishment Project
The CEPRA II project was completed just before Christmas; this was the best present the State and City could ever give to us. Under a separate CEPRA II project, the City of Galveston provided the funding to completely fill in the vacant front row lots.
CEPRA II rules specify that they must stay 20' away from any structure. Because of this, three single lots with houses on each side only received sand in the middle. This effort was to establish the maximum protection for the newly constructed Bermuda Beach Drive and the City's infrastructure. Bermuda Beach Drive had been destroyed by Hurricane Claudette in July of 2003.
The subdivision has applied for a permit that will allow each home owner on the front row the opportunity to fill in the 20' gap. We are waiting for the survey to be completed and added to the permit application. We encourage you to do this as soon as the permit is granted. We anticipate receiving it by the third week of March.
Getting these lots filled in by the City and State is the first step in possibly putting something more permanent in front of the homes and Bermuda Beach Drive. The WGIPOA is working with the City on the possibility of forming a (PID) Public Improvement District for us and other subdivisions that are suffering the same erosion problem. We are currently not looking at Geo Tubes but the newer Pro-Tec tubes that are constructed of sand color material and are deployed in a wedge against the dune. See www.advancedcoastaltechnology.com The BBIC has made NO DECISIONS on your behalf. This is a very big issue and we will put this to a vote if and when it looks like this is a feasible solution.
GOLF CARTS We want to remind you that golf carts or any other motorized vehicles are not allowed on the beach. We have been receiving numerous complaints of golf carts being driven on the street and over the dunes. We want to protect our new road and re-enforced shoulder. Please inform anyone visiting or renting your home the rules of the beach. Parking is allowed at the Pabst Rd. entrance. Do not pull boats or other large objects across the dunes, boats must enter and exit at Pabst Rd. only. Driving over the new shoulder will diminish the integrity of the stabilized shoulder protecting our new road base.
BOLLARDS
The new sand "filled to the top" is a great benefit, but with it comes the problem of driving on the beach. Tire tracks indicate that people have been driving off of Bermuda Beach Drive and down to the water. The BBIC is installing bollards every 5 feet across areas that driving has become a problem.
DEED RESTRICTIONS
The Deed Restriction Changes submitted to every property owner in September, 2003 did pass and has been registered. This change was basically to combine all 6 sections of Bermuda Beach under one set of regulations. This change will make it easier for the board to review regulations and suggest changes to fit the needs of the subdivision.
If a violation is noted, you will receive a telephone call or a post card to advise you of the of the problem. You will have 30 days to comply.
Regulation 1
No structure shall be erected, placed or altered on any building plot in said Subdivision until the building plans, specifications and plot plan showing the location of such building have been approved in writing as to conformity and harmony of external design with existing structures in said subdivision, and as to location of the building with respect to topography and finished ground elevation, by the Bermuda Beach Improvement Committee hereinafter provided for.
Structures, as that term is used herein, shall be held to include all buildings, fences, walls, swimming pools, playground equipment, outdoor cooking or heating facilities of a permanent nature, and any and all other improvements of a permanent nature.
OUTSIDE CONSTRUCTION
All
Outside construction requires Board Approval. This does not have
to be a formal blueprint. If you plan outside construction, such
as adding a new deck you must submit a plan to the board. You
also must obtain a permit from the city. The City is readily granting
permits and we want to urge you to comply in all instances.
SECURITY LIGHTING
Please install all new lights well under the structure of your home. Neighbors lights shinning in bedroom windows is the most common complaint we receive. A normal light will serve the same purpose without disrupting your neighbors. Please shield mercury vapor lights. Even though they appear to only light up your yard, they are like "headlights" in windows a block away.
Regulation 14
No sign, advertisement, billboard, or advertising structure
of any kind may be erected or maintained on any residential lot
without the consent in writing of the Bermuda Beach Improvement
Committee.
The undersigned or members of the Committee shall have the right
to remove any such sign, advertisement, or billboard or structure
which is placed on any residential lot without such consent, and
in so doing, shall not be liable, and is expressly relieved from
any liability for trespass or other tort in connection therewith,
or arising from such removal.
YARD SIGNS
Signs placed in a yard on a permanent basis must have board approval. If you have a permanent sign, and do not have a letter of approval from the BBIC, please apply for one by contacting a board member. Each sign request will be reviewed on an individual basis by all 5 members of the board. Signs must be neat, attractive and placed so that they do not obscure the view of other neighbors. It is preferred that all permanent signs be a moderate size and placed on the house.
YARD ORNAMENTS & ADVERTISING STRUCTURES
All decorations and furniture placed In the yard should be located Behind the set back line.
Regulation 17
All residences and other buildings must be kept in good repair and must be painted when necessary to preserve the attractiveness thereof.
STORM CLEANUP
Most properties have been repaired and cleaned up after Hurricane Claudette. However, there are several that have done nothing. We ask that you make arrangements to do this as soon as possible. We will be sending notices to those who do not comply.
We would greatly appreciate it if you would remove broken fences and pick up the rubble in your yards. We have just completed a major cleanup on the beach by removing all the concrete and rebar and with the State and City filling in the lots we have never looked better. Property values are at a peak, please help us by cleaning up storm damaged property.
Regulation18
The Bermuda Beach Improvement Committee shall have the following powers and functions:
a. Collect and expend, in the interests of the subdivision as a whole, maintenance, security or other funds as determined necessary.
b. Enforce these covenants and restrictions by appropriate proceedings (but this power shall not be exclusive and may also be exercised by any lot owner in Bermuda Beach).
c. Enforce any lien imposed on any part of this subdivision
by reason of the violation of any of these covenants or restrictions,
or by reason of failure to pay the maintenance charges herein
provided, and to execute
a release of such lien upon performance.
d. Approve or reject plans and specifications for improvements
to be erected in Bermuda Beach. All plans and specifications for
improvements must be submitted to the committee for approval prior
to the
commencement of construction of any such improvements. If the
committee fails to act within thirty days after submission to
it of plans and specifications, construction in accordance with
these restrictions may begin.

Regulation 19
Each lot in Bermuda Beach sold either by deed or contract of
sale by the undersigned, its
successors and assigns, is hereby subjected to
an annual maintenance charge from October 1 thru September 30
of One Hundred Forty-five Dollars ($145.00) and an annual security
fee of Forty-five Dollars ($45.00) to be paid by the owner of
each improved lot, the same to be secured by a lien upon said
lot, and payable annually on the first day of November of each
year next following the date of such deed or contract of sale
to Bermuda Beach Improvement Committee, at its office at 6610
Steward Road, PMB 174, Galveston, Texas 77551, or at such other
place as it shall designate in writing, and said charge and lien
are hereby assigned to said committee.
MAINTNEANCE FEES
At this time there are only 6 front row vacant lot property owners that have not paid. A $25 late fee has been added to the amount due. Second notices have been mailed. Third and final notice will be mailed by April 1. Failure to pay the $145 fee + late fee may result in a lien being placed on this property. All liens will be identified on our web page and in the Annual meeting newsletter going to all property owners.
During the CEPRA II City, State, and Subdivision project, all of these lots have been filled in. Vacant front row lots have benefited the most from the joint projects paid for by your neighbors. We urge you to pay your "fair share" by return mail.
