The 2004 ANNUAL MEETING

Carroll Cobb's presentation of the Shoreline Committee's recommendation for a Pro Tec Tube was the featured topic. The date for sending back the PID Poll was extended to make sure everyone had an opportunity to voice their opinion. Complete minutes are published on the Bermuda Beach web site and will be distributed to all prior to the next Annual Meeting.


PID POLL Final Results

The total Yes 49% of the total lots in BB. We felt we needed at least 51% to proceed to the next step of hiring an engineering firm. We also contacted the Surfside Project Coordinator and obtained "real cost estimates" of their project from their engineering firm. This was more than double what had been presented to us.

We have now established in writing, by contractors, engineers, venders and academic institutions a known sub total of $3,433,900. Sand and engineering was the greatest discrepancy discovered from the figures Spanish Grant initially presented to us.

The Pro Tec Tube project at Jamaica beach is now at a standstill because of sea turtle monitoring and because of the lack of sand at a reasonable price. During this period other sand sources are being investigated.

Al Birdwell, Chairman of the BBIC Shoreline Protection Committee has advised that because of the onerous restrictions and regulations of the State, and the City's sand moratorium on excavation, it would be impossible to maintain the tube.

The Texas Administrative Code: Title 31, Part 16, Chapter 501, subchapter B Rule 501.26 Policies for Construction in the Beach/Dune System "the width must be maintained at all times." In other words, if a sand sock takes 15 to 20 feet of beach then the beach must be constructed seaward of the tube another 15 to 20 feet. This would mean we would have to change the shoreline and extend sand out into the water. This beach width would have to be maintained at all times.

To paraphrase WGIPOA board member, Marty Baker at the April Erosion Task Force Meeting, there isn't enough money on the entire west end" to pay for the sand needed to meet the current requirements mandated by the Texas Administrative Code. The WGIPOA is avidly working to have this restriction changed.


SAND MORITORIUM

Jerry Mohn, President of the WGIPOA reported that the City's moratorium on sand was lifted in late December but the new ordinances enacted by the City will not allow any sand excavation for beach nourishment unless the area is above grade or a new construction site. Jerry is on the WELUPC Committee and hopes that at the next meeting the committee will approve an addendum to allow sand excavation for beach nourishment - no one understands how much emergency sand is needed after a storm event. This is a critical issue that needs to be changed as soon as possible.


CEPRA IV

At the recent April Erosion Task Force Meeting, the County requested that subdivisions prepare their Project Goal Summaries by May 1. Funding for CEPRA IV should be available after September of this year. We will again plan another beach nourishment project and a possible Dune replacement project. This will be subject to City approval. New sources of sand are being investigated by Shiner Moseley Engineering Co. and Galveston County.


BARBECUE AT THE COKER'S

Following the Annual Meeting the BBIC barbecue was held at the home of Mildred and Ron Coker. The food was great, thanks to all of the good cooks in Bermuda Beach who bring their special side dishes and fabulous desserts. If you missed it this year, make plans to attend next year, it's a great time to visit and meet new neighbors.


FENCE & SIGNS

At the October 2004 Annual Meeting, the BBIC board presented the guidelines they have adopted for approval of Fence and Signs. The BBIC requests that The BBIC requests that property owners adhere to all Deed Restrictions and all signs and fences be brought into compliance voluntarily.

FENCES All fences must be Board approved BEFORE installation. Height 4' or
under and constructed of natural unpainted wood or wood substitute. Chain link fences will not be approved. When damaged by storms, existing chain link fences must be removed completely and may not be replaced. Damaged fences and pickets must be replaced in a timely manner and brought into compliance.building Permits, when applicable, be obtained from the City of Galveston and coordinated withBBIC Board approval.

SIGNS Temporary signs may not exceed 4 sq. feet and may be posted for no more than 60 days. Political signs must be removed the day after the election. Only one sign per street front shall be permitted.

Permanent signs such as "Vacation Rental" must be located on the house and not exceed 4 sq. feet. No more than one sign per street front shall be permitted. Signs of this nature and size will not need Board approval. Any other type of sign must be approval.

For Sale by Owner signs should be in a size and placement similar to those being used by local realtors. Such signs may not exceed 4 sq feet and are limited to one sign per street front.

Advertising signs of any kind are not permitted except during construction or painting. Contractor's signs may be posted in yards only during the actual construction.

Al Birdwell, the BBIC Delegate to the WGIPOA has recently sold their property and moved near Tomball TX. We would all like to thank Al for his dedicated service to Bermuda Beach and the West Galveston Island Property Owners Association. Al served on the WGIPOA Board as their Treasure as well as serving on the Bermuda Beach Board. Al and Carolyn will be greatly missed.

HURRICANE SEASON APPROACHES

FYI for New Property Owners:

If we are hit with a hurricane, tropical depression, or if you have ANY storm related damage, Get Your Permits Immediately. Try to at least reconnect to sewer, water and electricity during the 30 day emergency time frame. This will save you many headaches later. Get permits even though you may not do the work until after you settle with the insurance. Reconnecting to utilities may keep you from being condemned. After 30 days, emergency permits to reconnect can be denied and you will have to go through the entire process of getting a beach construction permit. This takes 6 weeks and longer if not denied.

You must act quickly. Any questions call one of the board members.


PUBLIC MEETINGS

There are two public monthly meetings that are beneficial for all property owners to attend. These two meetings offer the opportunity for individuals to ask specific questions of interest to you and keeps they keep you informed on issues that may directly affect you and your properties.
