STATUS OF IKE DAMAGED HOMES

Many of you have inquired as to the status of the homes that are still damaged from Ike. After almost two years, there are a few homeowners who have done nothing to repair or remove these homes. Complaints and concerns from adjacent property owners continue to pour in. These houses diminish the property value of all Bermuda Beach homes. Residents are also concerned that their property will be damaged or someone will be injured by these abandoned homes.

We want to advise Bermuda Beach residents that we are working diligently with the City/State and we will be seeking legal action to bring these houses into compliance. These homeowners have been notified repeatedly by the BBIC (below is the most recent correspondence).

Dear Bermuda Beach Homeowner:

The Bermuda Beach Home Improvement Committee (BBIC) is charged with enforcing the Bermuda Beach Deed Restrictions for the benefit and safety of all Bermuda Beach property owners and residents. Your Bermuda Beach home is in violation of sections 10, 13, and 17 of the Bermuda Beach Deed Restrictions and is a danger to Bermuda Beach residents and their properties. The BBIC Board has previously notified you by USPS mail/e-mail/phone about the violations and has tried to work with you to bring your home into compliance. Unfortunately, you have failed to take any action to remedy the violations or to notify the BBIC Board in writing of the reasons for not repairing or removing your home.

Your refusal to voluntarily comply with the deed restrictions and/or notify the BBIC Board in writing of the steps you are taking to come into compliance forces BBIC to seek all remedies available to enforce the deed restrictions, including, but not limited, to legal action. We are sorry that it has come to this, but action must be taken to protect all Bermuda Beach property owners.
Very truly yours,
Bermuda Beach Home Improvement Committee
